As a buyer of a condo in Sonesta One Jaco, I received an email from the Developer, Joshua ten Brink of Riverside Developers during Eastern Week 2010, saying that he is suing the bank who lent them the money to build the project of One Jaco Place in Jaco, later Sonesta Jaco Resort.

The reason, he alleges in his email to those who bought a unit or put earnest money down against an option to purchase/sale agreement is that the bank who lent him the money (BCIE) because they are changing the rules on them and they can not afford to finish the condo buildings.

Meanwhile, some of us closed on the purchase and some others have paid the earnest money but will not close or cannot close for one reason or the other and the whole project will be tied up in court for who knows how long.

If personally held, the foreigner must first have five years of legal residence in Costa Rica. For this reason, many foreigners purchase the rights to beach real estate or ocean front property by first forming a Costa Rican corporation, a simple process that takes about 30 days and can cost from $150 to $1,000, depending on the attorney that constitutes it, the type of corporation or if you use a typical shelf corporation.

Your Costa Rican corporation must have at least fifty percent of its shares held by a Costa Rican resident or citizen. Most people are not comfortable with this so at the time of closing the sale, the "token" Costa Rican shareholder, simply endorses the shares to the foreigner so that the foreigner is holding 100% of the shares.

The new Costa Rica corporation tax was approved in January 1012 and though I thought someone would put a motion against in in the Sala IV, but that didn’t happen, so the new law seems to be going into effect on April 1st, 2012. My blog on January 7 tells you the whole story about the new Costa Rica corporation tax and how much you should pay and my blog on January 8 tells you how it interferes with your business or the Costa Rica real estate you have incorporated.

Between January and now, I have received lots of emails asking how you can pay the tax. Well, the government created the tax but didn’t create a solution to make the payments. Today I can give you the great news that the National Register and the Banco de Costa Rica (BCR) agreed on working together on this.

This article said things like Costa Rica has the highest inflation rate in Central America, From shopping marts to the gas pump, everything seems to be expensive in Costa Rica. Some experts seem to have found the answer: My explanation is the appreciation of the colón, My suspicion is that Costa Rica is so expensive because the price of fuel and the costs to transport the fuel are transferred to the cost of goods and We have one of the highest production costs in the region.

(a) Changing the Name on the Utility Bills

Once the property transfer title is recorded it is the responsibility of the property owner to transfer utilities from the name of the Seller to the name of the Buyer. Although this would appear to be a simple task, in Costa Rica it is not. In many cases a telephone line cannot be transferred and the Buyer must use the telephone line and leave it in the name of the Seller.

The 28 years living in Costa Rica have made me wiser and I have realized that paradise doesn’t exist, you make paradise yourself.

Throughout those years, I have always worked hard, first to survive, as I was learning how to live in Costa Rica with a different culture, a different language and a different way of doing business, learning to adjust to all these new things. Many North Americans don’t know you can buy real estate in Costa Rica with your self-directed IRA (Individual Retirement Account) or your 401(k) (Retirement Savings Account) as an investment. Canadians can use their RRSP (Registered Retirement Savings Plan). Very few Costa Rica real estate agents know how you can realize the purchase without running into trouble. You will need the cooperation of your IRA custodian and you need to have a Costa Rica real estate attorney who knows what needs to be done and of course an American European affiliate real estate agent for your purchase.

Self-Directed IRA

The IRS rules permit IRA funds to be invested in real estate but they do not require an IRA trustee to offer real estate as an investment option. Many trustees who offer traditional IRA investments, such as depository banks, do not allow IRA owner to invest in real estate because of the extra administrative burden of real estate management. As a result, if you want to invest your IRA funds in Costa Rica real estate, you will probably have to convert your traditional IRA to a self-directed IRA. A self-directed IRA is an IRA that requires you to decide what investments to make yourself.

Buying Costa Rica real estate is not so easy to do it on your own, especially when you are making the purchase without the involvement of an experienced Costa Rica realtor. When My wife and I drove to Nativa Resort a couple of weeks ago, I noticed that on the new highway to Caldera, the Autopistas del Sol concessionary was doing landslide prevention different ways.

Landslide protection and prevention techniques

Autopistas del Sol sprayed liquid concrete on the hillside and drilled pipes into the mountains to take the water out and through the concrete, when they re-did part of the highway at the Sabana and Escazu turnoff. This was the first time I saw this technique used in Costa Rica, though I have seen is used in Spain and Canary Islands quite a bit. They are also using a way different technique a little past the beautiful town of Atenas, where they are now making incredible use of the large rocks they took out before they put the pavement in.

The applicant of a temporary residency in Costa Rica as an investor (Inversionista) has to demonstrate the Department of Immigration that they will be coming to Costa Rica to invest in the country.  The law specifically excluded personal investments in the past, such as the purchase of a home in Costa Rica, lots or buildings to qualify for this category, but on August 28, 2009 the Director of Immigration issued Circular UPI-239-2009-LAS which modified the types of investment that could be made to qualify for this category.

Between the US government and Costarican government, they’re doing everything they can to keep tabs on everything you do and especially on how much money you earn. Just last year, the Costarican government created the Dimex residency card through which they will be able to control your banking business in Costa Rica.

Of course, those who don’t have anything to hide don’t have to worry about anything, which is the large majority. The New York Times, on the 27th of December published a long article about Fatca with the title “Law to Find Tax Evaders Denounced“.

After seeing and hearing about Walmart when I was at home near Sabana, felt I just have to write about supermarkets in general and particularly grocery shopping in Costa Rica. There are so many myths and strange ideas here.  Maybe it is my partly Scottish blood coming out but I hate to pay more than necessary. It is surprising many locals just dont even compare prices.

Walmart in Costa Rica has lots of discounts but is still higher priced. They mention over 4000 articles discounted in their advertising. One discount I saw was down to ¢3220 in very large print (down from 3254 colones in very small print, which is 1%). The signs cost more than the saving! They are probably fooling many, but do have a good variety and some real discounts.

Costa Rica doesn’t have escrow laws like the United States has, but because there are so many foreign buyers of real estate in Costa Rica, some real estate attorneys as well as some title companies offer escrow services, though most call it a trust account. If you are planning to purchase a home in Costa Rica and you don’t already have the amount needed for the purchase in a Costarican bank account, there are some steps that I can recommend that will make your purchase easier on you.

1.    Make sure you deal with a real estate agent in Costa Rica who knows what escrow is.

2.    Make sure you already know your real estate closing attorney has an escrow account and he/she has a good reputation.

3.    Make sure your real estate agent writes up the offer, including all the necessary details. Once approved by both you and the seller, the agent should get your real estate attorney to write up a reciprocal purchase - sale agreement that points out all the details of the purchase.

In January of 2010, the new Caldera highway linking San Jose to the Central Pacific Coast was officially opened, changing the outlook for real estate in Jaco Beach and the surrounding areas. The new highway makes the drive from Jaco to Escazu, the popular upscale suburb of San Jose just about one hour, a journey that was previously almost 2 hours.

The first one is the one I like to call a home uplift. This is the kind where you’re changing tiles, kitchen cabinets, ceramic flooring, changing the roofing tiles or metal sheeting, etc. These kinds of renovations are, for the most part, easy and do not cause too much pain. No municipal permits are required and most of the work is usually done by contract, i.e.  you contract out the tiling work by the square meters, and the kitchen cabinets to a cabinet maker, etc.

As a buyer of an apartment in Sonesta One Jaco, I received an email from the Developer, Joshua ten Brink of Riverside Developers during Eastern Week, saying that he is suing the bank who lent them the money to build the project of One Jaco Place in Jaco, later Sonesta Jaco Resort. The reason, he alleges in his email to those who bought a unit or put earnest money down against an option to purchase/sale agreement is that the bank who lent him the money (BCIE) because the are changing the rules on them and they can not afford to finish the buildings.

Meanwhile, some of us closed the purchase and some others have paid the earnest money, will not close or cannot close for one reason or the other and the whole project will be tied up in court for who knows how long. I, as a owner of real title (our unit is totally finished and we furnished and equipped it) now have an apartment in an empty and unfinished building which I cannot rent or even when I use it myself, the elevators will not work half the time, or I have no hot water and a long list of other issues.

Do you see the smile on this face?  That smile is because Costa Rica took top honors in the latest Happy Planet Index, which reports Costa Rica as having the highest life satisfaction in the world, the second-highest average life expectancy of the Americas (just behind Canada), and a respectably low ecological footprint.  It's interesting to note that the report states, "The three largest countries in the world, China, India and the USA (all aggressively pursuing growth-based development models), have all seen their [Happy Planet Index] scores drop."  The United States ranked 114th in the index.

I am a Costa Rica real estate agent and I see real estate listings all the time. And when I list a new property for sale on our website, I try to look at the listings from the eye of a buyer: Would I click on this to see more of the property?

A real estate agent is neither a photographer nor a writer and it is not always easy to make a nice write-up and a good photo presentation of a property for sale. Many properties just look terrible and the realtor has to make the miracle happen. Besides, in Costa Rica we don’t have exclusive listings in most areas and a property for sale will be listed by multiple real estate agents even though we have an MLS. So why bother to spend a lot of time on making a listing look good if every real estate agent in town has the same listing? That’s what a mediocre real estate agent would think. The photos below, all show lack of interest by the listing agent to my opinion.

When I first moved to Costa Rica in 2004, my wife and I would walk the beach nearly everyday. One morning I had a feeling of being transported back to that 70's tv show, Gilligan's Island when I found myself watching a man climb up a palm tree, knock down a few coconuts, cut the top and then drink the liquid inside. It seemed so alien yet exotic and it brought a bit of childhood nostalgia back. puravida.jpgSometimes I love that Pura Vida lifestyle, sometimes I just hate it. It is part of life in Costa Rica. But what does it mean? It means a zillion things. The Costaricans and others who live in Costa Rica use it mainly as a greeting, like "hi, how are you".  Or as an answer to the "how are you" it means "I am doing great, I am fantastic, I'm as happy as one can be". It means that life is great. It means a lifestyle that is all about taking it easy, enjoy life. You will find more of the Pura Vida lifestyle around the beach areas than in the cities, but as a greeting it is used in both.

Wikipedia shows it means the following, though I agree only partially: Pura vida literally means Pura = pure and vida = life, but "Pure life" in Spanish would be "Vida pura" instead, so the real meaning is closer to "plenty of life", "full of life", "this is living!", "going great", "real living", or "cool!"[1] It can be used both as a greeting and a farewell, to express satisfaction, to politely express indifference when describing something [1] or even to say "thank you". For many years you could only bank in Costa Rica with banks that were owned by the government of Costa Rica, like the Banco Nacional de Costa Rica and the Banco the Costa Rica, the two largest. Not until President Carazo’s government from 1978 - 1982 was private banking allowed, but only for saving deposits and in 1984 were they allowed to participate in mortgages and credit loans. In 1995, private banks finally were authorized to offer regular bank accounts, saving accounts and other financial services to their clients.

This was a big turnaround on services because it obliged the state owned banks to train their employees to become service minded and especially the business community started moving over to private banking. For years, most businesses had to have messengers just to stand in line for hours at the time, so they could make their deposits or pay their utility bills.

Can you compare Costa Rica real estate with Florida real etate? An article in an online newspaper on Florida real estate this week, gave me a good reason to follow up on my last week article “Should Costa Rica real estate adjust its prices or not”. I am shocked at how little the Florida market has improved while the Costa Rica real estate market has improved incredibly. But most importantly, the Costa Rica real estate market has never suffered as much as Florida and some other markets have. It’s a matter of sheer numbers.
An October refurbish from Chip Rowand of the Keyes Co. in Weston, Florida shows that Broward County has 13,480 single-family homes and condos for sale. In Palm Beach County, there are 15,782 homes and condos on the market. Those totals are half of what they were a few years ago, Rowand said.

Costa Rica real estate does not adjust its prices for a several reasons. Scott Oliver’s wakeup call in his We Love Costa Rica newsletter about sellers of properties in Costa Rica who need to get “real” about their sales prices is one of many who complain about the real estate prices in Costa Rica not coming down as expected. An email from our Heredia real estate affiliate partner Xinia Salazar about a discussion she had with a “motivated seller” made it even more obvious there is need for an explanation why the prices of Costa Rica real estate, stay the same as they were before.

Let me explain. Scott Oliver, in his article, is telling the sellers of Costa Rica real estate, that they should adjust their pricing to the reality of a world crisis. While buyers are not standing in line to purchase property that is not a bargain, sellers still want to have the real estate agents take the listing at high prices. Scott is telling the sellers in his article that if they are not motivated, they should not list their property.

Buying Costa Rica real estate is not so easy to do it on your own, especially when you are making the purchase without the involvement of an experienced Costa Rica realtor. When My wife and I drove to Nativa Resort a couple of weeks ago, I noticed that on the new highway to Caldera, the Autopistas del Sol concessionary was doing landslide prevention different ways.

The concessionairy sprayed liquid concrete on the hillside and drilled pipes into the mountains to take the water out and through the concrete, when they re-did part of the highway at the Sabana and Escazu turnoff.
